SC allows Pune police to continue activists’ probe

PUNE: Refusing to interfere with the investigation into the arrest of five activists in connection with the Bhima-Koregaon incident by the Pune police, the Supreme Court of India allowed the process to continue, although it provided a way out for the activists by extending their house arrest by four more weeks, allowing them to move bail applications in this time.

In a 2:1 majority verdict, the three-judge bench headed by Chief Justice Dipak Misra dismissed the petition filed by historian Romila Thapar and four others seeking the release of Gautam Navalakha, Sudha Bharadwaj, Varavara Rao, Arun Ferreira and Vernon Gonsalves and also the appointment of a Special Investigation Team. The top court held that the accused persons do not have a say “to choose as to which Investigating Agency must investigate the offence committed by them”.

In a pan-India crackdown on August 28, the activists were arrested for suspected Maoist links. The raids were a part of a probe into a conclave, Elgar Parishad , held in Bhima Koregaon near Pune on December 31, 2017 that allegedly triggered violence the following day.

But dissenting with the two judges, Justice DY Chandrachud held that there was a need to constitute a SIT and hand over investigation to it. “Circumstances have been drawn to our notice to cast a cloud on whether the Maharashtra police has in the present case acted as fair and impartial investigating agency. Sufficient material has been placed before the Court bearing on the need to have an independent investigation,” he added.

The majority judgment said the police is free to go ahead with investigations and “it is not a case of arrest because of mere dissenting views expressed or difference in the political ideology of the named accused, but concerning their link with the members of the banned organisation and its activities”.

Rebutting the argument of the petitioners that there is no evidence against the five activists, Justice AM Khanwilkar, writing the judgment for himself and the Chief Justice, held that there is “no mala fide exercise of power the he police”.

Justice Khanwilkar in the judgment also held, “This is not the stage where the efficacy of the material or sufficiency thereof can be evaluated nor it is possible to enquire into whether the same is genuine or fabricated.” The judges also refused to comment on the evidence collected by the police as it could prejudice the case.

“The option to proceed in the case with more arrests is open before us,” said Pune police commissioner K Venkatesham after the SC ruling. “This judgment is the recognition of professional work done by the investigating team.”

Justice Chandrachud came down heavily on the police for holding media briefings in the case while the matter was in courts. He said, “In the present case, police briefings to the media have become a source of manipulating public opinion by besmirching the reputations of individuals involved in the process of investigation. What follows is unfortunately a trial by the media. That the police should lend themselves to this process is a matter of grave concern.”

Making a case for an independent probe, Justice Chandrachud highlighted the recent case of Nambi Narayanan, who was framed by Kerala police in the ISRO sying case. He said a CBI probe in the case exonerated Nambi Narayan and he was awarded him 50 lakh as compensation for wrongful prosecution.

The petitioners said their stand had been “vindicated” by the “dissenting verdict” delivered by Justice Chandrachud. Addressing the media in New Delhi, historian Thapar said due to the top court’s judgment the liberty and dignity of the human rights activists had not been “jeopardised” for the time being.

Supreme Court advocate Vrinda Grover, who represented the petitioners, said: “Justice Chandrachud has categorically held that liberty cannot be sacrificed at the altar of conjecture.”

MahaMetro to start work on Karve road flyover soon

PUNE: The Maharashtra Metro Rail Corporation will start the preliminary work on the proposed double-decker flyover at Nal Stop in October. MahaMetro said that it was planning to start installing barricades on the stretch in question, on Karve Road, over the next two weeks.

An official said they would hold a meeting with the city traffic police department to discuss the traffic management plan during the project’s execution. The plan includes a proposal to implement rotary traffic movement at Nal Stop, on Law College Road and near SNDT.

The bottom tier of the 500m-long flyover is meant for vehicular traffic, while the top tier will have the viaduct for the Vanaz-Ramwadi Metro line. Work on both tiers is expected to begin simultaneously.

Sources in the Pune Municipal Corporation said the corporators want chief minister Devendra Fadnavis to be the chief guest for the ground-breaking ceremony. However, PMC office-bearers have been unable to get an appointment with the CM in the past month.

Managing the flow of traffic and avoiding jams are among the biggest challenges in executing the project, which is a crucial component of the Metro plan on the Karve Road stretch. MahaMetro said that it is ready with a plan of action for civil work. A width of six metres on both sides will be left free for vehicles during the construction phase.

MahaMetro officials said the pillars of this project, once built, will not hamper vehicular movement on the road, as the plan was drawn considering the alignment of Nal Stop Chowk. “The pillars will not be a hindrance to traffic even if (traffic) changes are introduced in the future,” an official said.

Trupti Desai to visit Sabarimala Temple

PUNE: Social activist Trupti Desai, who has been spearheading the right to pray movement in Maharashtra, is ready to visit Sabarimala Temple with the Supreme Court (SC) allowing entry of women of all ages into the shrine in Kerala.

The apex court on Friday lifted a ban that prevented women and girls aged between 10 and 50 from entering the famous temple, holding the centuries-old religious practice as illegal and unconstitutional. Hailing the SC judgment, Desai told TOI that there should have been no restrictions of any kind that discriminated and denied the menstruating women the right to pray.

Desai’s Bhumata Ranragini Brigade had in the past led an agitation to allow entry of women into Shani Shingnapur Temple. Subsequently, Desai announced a campaign for women’s entry into Sabarimala Temple. But some activists in Kerala opposed her entry into the shrine.

Activist and lawyer Asim Sarode said, “The restrictions on women were violation of equality and fundamental rights.”

Don't write directly to PM, President : HC

PUNE (MUMBAI): The Bombay High Court deprecated the practice of people writing directly to the prime minister, the president or chief minister making wide allegations against certain persons instead of following due process of law.

A division bench of Justices S S Shinde and Mridula Bhatkar said this tendency of bypassing procedure laid down in the law and writing directly to top constitutional functionaries seems to be aimed at seeking publicity.

The bench made the observation while hearing petitions pertaining to the January 2018 violence at Koregaon-Bhima village in Pune district. While one petition filed by Pune resident Satish Gaikwad, who claims to be a victim of the violence, sought an inquiry by the National Investigation Agency (NIA) into the case, another plea by social activist Abdul Malik Chaudhary demanded a state CID probe.

Referring to Chaudhary's plea, the bench noted earlier the petitioner had written a letter to the prime minister, president of India and Maharashtra chief minister. "In the letter, the petitioner has made wide allegations against several persons and has in fact even involved a neighbouring country. This is very unfortunate that people write letters to prime minister and president instead of following due process of law," Justice Shinde said.

The law permits a person to approach the police or a magistrate to lodge a complaint and get their grievances addressed, the court noted. "It seems like these persons only want publicity and popularity," Justice Shinde said. The bench adjourned hearing on the petitions till September 17 after observing that a similar plea pertaining to the June arrest of five activists for their alleged links with Maoists would be heard on September 12.
